Although Clare Cavanagh’s book does not emphasize this theme, her tactics could hardly be better suited to Mandelstam’s peculiar poetic sensibility.Osip Mandelstam and the Modernist Creation of Tradition is an exhaustive exploration of historical and cultural context. It opposes itself explicitly to the traditional structuralist and semiotic approaches to Mandelstam, and takes his works in their “secular” rather than their “hermetic” aspect (to borrow terms from Robert Scholes). In that sense it seeks to recollect and bring to mind everything that might affect our understanding of Mandelstam’s oeuvre. This turns out to be a varied field: Pound and Eliot (coeval modernists whose ideas resonate significantly with his), François Villon, Byzantine and Gothic church architecture, the marginalized yet culturally dynamic position of the Russian Jew, Pindar (an exemplar of the social-economic relation of poet to state), Dante, the psychology of literary play, and even Charlie Chaplin. Although it does not use extensive biographical framing, the book proceeds through Mandelstam’s poetry and prose in chronological order, alternately pursuing aspects of context and concentrating on selected works by Mandelstam for sustained analysis.What results is perhaps the most serious comprehensive work on the poet produced so far. Cavanagh’s approach may appear diffuse at first, but it enables her to capture a great deal of this elusive genius without confining Mandelstam within a narrow critical purview. The book’s argument is that Mandelstam qualifies as a central modernist poet through his agonistic relation to an ideal of “world culture.” He attempts to recreate an authoritative literary and cultural tradition that his own innovative work would both continue and transform. And it is from this point of view that Mandelstam’s Jewishness appears so significant to Cavanagh (a chief issue in three out of eight chapters): it gives a precise formula for that position both inside and outside of the dominant culture. Cavanagh even contends quite suggestively that, for Mandelstam, both Dante and Chaplin function as avatars of Jewishness.All this is well-founded and important, but perhaps the best thing about her book is that its central argument doesn’t do justice to the richness of Cavanagh’s own materials. Her discussion does not weaken, for instance, as it leaves Mandelstam’s early period, when the notion of “world culture” was indeed an obsessive one for him. The book is equally effective on the brilliant late poems of the Voronezh cycle, by which time not only a place in world culture but even a secure place in human society seemed futile dreams to Mandelstam. Cavanagh’s readings of the prose and especially the poetry are flexible and sensitive; she gives beautiful accounts of the poetic wordplay and follows closely the ebb and flow of musicality in the verse from one period and [End Page 258] collection to another. Fiske, Understanding Musical Understanding: The Philosophy, Psychology and Sociology of the Musical Experience. (Lewiston, New York: Edwin Mellen Press, 2008).Building on several earlier publications on music and the mind (1990, 1993, 1996, 2004), Harold Fiske offers Understanding Musical Understanding. This is a well-referenced piece that outlines the thinking of various authors (for example, (...) Crowder, 19931; Huron, 2006;2 Snyder, 20073). Furthermore, as Fiske meticulously constructs his case, it draws in psychologists such as Carl Seashore and philosophers like Aristotle, Hegel, Kant, and Schopenhauer. All this suggests an author of great expertise and wide appeal.Fiske begins to build his argument by discussing musical cognition in terms of ‘time’ (Chapter 2) and ‘shape’ (Chapter 3) returning to these themes in greater detail in Chapter 6. It may seem axiomatic that music is perceived structurally and through time. Yet, as the author mentions, the capacity for someone to designate musical form is no way in which to illustrate systematically the workings of musical understanding. This happens swiftly and unceasingly in the course of a person’s musical encounter. It is commonplace, too, for musicians and listeners to allude to visual imagery and shape when describing music (for example, ‘high [End Page 204] and low pitches,’ ‘a texture that is dense or thin,’ or ‘an angular melody’). Fiske contributes a plausible explanation of musical shape:... the perceived shape of music can only be the outcome of a construction (not reconstruction or ‘copy’) calculated on the part of the neural network mechanisms… The ‘reality’ of a musical-auditory image is likely a result of imposing a three-dimensioned visual perspective on an inherently unstructured (invisible, tasteless, intangible, and otherwise unknowable) transitory experience. This is the only means the brain has for making sense of a sound event. What it seems to do is: identify relevant cues, piece the cues together into patterns that can be retained (in the echoic memory) long enough for brain mechanisms to examine and create the sense that we can ‘look’ at music by invoking principles borrowed from vision, and then creating the impression of an auditory ‘object.’ The ‘object’ seems complete and multidimensioned but is, however, only remotely related to what we hear during the slit-like limitations of the perceptual ‘now.’(p. 56).Nonetheless, the manner in which we communicate musical perception with terms borrowed from vision does not inconclusively evidence the same mechanisms of human thought on receiving visual or, on the other hand, musical stimuli. Use of such language may only represent an opportune mode of expressing phenomena to which we have no dedicated vocabulary. Fiske argues that musical understanding is part of the human organism’s genetically-inherited capacity to construe (rapidly invent) patterns from sonic stimuli thus making sense of temporal experience. This process, he argues, is part of the brain’s facility to determine quickly the source, kind and meaning of stimuli for the organism’s immediate safety and survival; the mental processes involved are regulated by ‘brain time’ as opposed to ‘clock time.’ Brain time is “... a rapid, micro-temporal, flexible-variable scheme...” (p. 8) in contrast to pre- and externally-determined ‘clock time.’Musical memory is addressed in Chapter 4 in tandem with ‘pattern constructs.’ Pattern constructs, Fiske explains, are ‘chunks’ of learned musical experience encoded in ‘brain time’ as multi-dimensional, unidirectional entities (p. 63). There is evidence of the ‘inner replay’ of learned events such as these.4 Incoming musical information is perceived, though, according to the listener’s cognitive context, and perhaps retroactively linked for ‘best fit’ rather than being ‘measured’ against fixed expectations and pre-established contextual information, say, about genre. The degree of ‘best fit’ either confirms or modifies assumed context. An important point Fiske makes, then, is that “... a misfit... between incoming information and the presumed context” evidences learning (p. 84).5 Since a ‘misfit’ triggers modifications to the cognitive context by which a person discerns music, it enriches his or her musical knowledge and understanding. In this book, Eli Hirsch focuses on identity through time, first with respect to ordinary bodies, then underlying matter, and eventually persons. These are linked at various points with other aspects of identity, such as the spatial unity of things, the unity of kinds, and the unity of groups. He investigates how our identity concept ordinarily operates in these respects. He also asks why this concept is so cental to our thinking and whether we can justify seeing the world in (...) terms of such a concept. Indeed, at the Council of Chalcedon in 451, the gathered bishops and representatives of the church across Africa, Asia, and Europe agreed that Jesus Christ was “perfect in divinity and perfect in humanity”: teleion…en Theótæti kai teleion…en anthropótæti.Theologians and patristics scholars alike often sort through the second part of this formula in the way that the remainder of the conciliar definition itself seems to indicate, interpreting (...) it to mean that nothing that belongs to the humanity we share can be lacking in the humanity of Jesus, and nothing belongs to Him that would compromise the human form. He does not, for instance, have a body animated by a divine spirit in place of a human will, or a superhuman ability to translocate. This is theologically appropriate as far as it goes, but it does not go far enough. (shrink)

In the first twelve chapters of this book, I am concerned with the Fregean notion of an object (the reference of a proper name) and its connection with the notion of identity. The rest of the book is devoted to a discussion of the problem of personal identity.

The aim of the paper is to discuss some recent variants of familiar puzzles concerning the relations of parts to wholes put forward by Trenton Merricks and Eric Olson. The argument is put forward that so long as the familiar distinction between 'loose and popular' and 'strict and philosophical' senses of identity claims is accepted the paradoxical conclusions at which Merricks and Olson arrive can be resisted. It is not denied that accepting the distinction between 'loose and popular' and 'strict (...) and philosophical' senses of identity claims is itself a departure from common-sense, but it is argued that it is the smallest such departure available to us. Since the introduction of the U.S. Sarbanes-Oxley Act in 2002 and several other national corporate governance codes, whistleblowing policies have been implemented in a growing number of companies. Existing research indicates that this type of governance codes has a limited direct effect on ethical or whistleblowing behaviour whereas whistleblowing policies at the corporate level seem to be more effective. Therefore, evidence on the impact of (inter)national corporate governance codes on the content of corporate whistleblowing policies is important to understand their (...) indirect impact on whistleblowing behaviour. This study analyzes the contents of whistleblowing policies, and parts of corporate codes of conduct and codes of ethics, describing such policies of 56 leading European companies. By classifying the contents in seven categories, an exploratory framework was created. General contents often identified were: applicability to all employees, a group-wide scope and an authoritative tone. The most common general violations to report were breaches of internal policies and external regulations or laws. The more specific violations most frequently mentioned were criminal offences and dangers to health and safety or the environment. Contacts to report to were the direct or indirect supervisors, a compliance officer or a confidential “hotline” facility. A confidentiality guarantee was common and anonymous reporting was often possible, though sometimes discouraged. Protection against retaliation is stated by ensuring that retaliation will not happen, prohibiting it or making it punishable. The requirement of good faith was frequently given. Finally, investigation of the report was often guaranteed. Surprisingly little information is given on the treatment of whistleblowers reporting an unfounded complaint in good faith, or reporting a violation they were involved in. The study’s findings are most relevant to companies without a whistleblowing policy or those that intend to benchmark their policies, and to pan-European standard setters. (shrink)

How is the debate between presentism and eternalism to be characterized? It is usual to suggest that this debate about time is analogous to the debate between the actualist and the possibilist about modality. I think that this suggestion is right. In what follows I pursue the analogy more strictly than is usual and offer a characterization of what is at the core of the dispute between presentists and eternalists that may be immune to worries often raised about the substantiality (...) of the debate. I suggest that the debate be characterized in Lewisean terms and define positions I call *Lewisean* eternalism and anti-*Lewisean*' presentism (analogous to Lewisean possibilism and anti-Lewisean actualism). I explain some advantages of the proposal and discuss some objections. I conclude that pursuing the analogy strictly offers the prospect of giving clear sense to a controversy which otherwise seems to many deeply obscure. (shrink)

A clarification of Naess's ?depth metaphor? is offered. The relationship between Naess's empirical semantics and communication theory and his deep ecology approach to ecophilosophy (DEA) is developed. Naess's efforts to highlight significant conflicts by eliminating misunderstandings and promoting deep problematizing are focused upon. These insights are used to develop the implications of the DEA for environmental policy. Naess's efforts to promote the integration of science, ethics, and politics are related to the National Environmental Policy Act (NEPA). The action?oriented aspect of (...) deep ecology, its focus upon redirecting environmental policy, is also highlighted. The discussion is framed by Brian Norton's contention, in Toward Unity Among Environmentalists, that Naess's deep/ shallow distinction is not consequential. In the final section some of the uniqueness of Naess's contribution is intimated, the ?sturdiness? of deep ecology's foundation is considered, and directions for future theoretical and practical contributions are suggested. As will be observed, Naess has many important insights to offer, but some vexing issues persist. (shrink)

The concepts of time and identity seem at once unproblematic and frustratingly difficult. Time is an intricate part of our experience -- it would seem that the passage of time is a prerequisite for having any experience at all -- and yet recalcitrant questions about time remain. Is time real? Does time flow? Do past and future moments exist? Philosophers face similarly stubborn questions about identity, particularly about the persistence of identical entities through change. Harold Laski (Manchester, 1893-Londres, 1950) es de los pocos teóricos del Estado en el mundo anglo-sajón que, desde John Stuart Mill, merece ser recordado. Sus teorías se desenvuelven en el tránsito del pensamiento liberal a la acción de tipo socialista. Fue miembro de la renombrada Fabian Society aunque renunció a su puesto en el Comité Ejecutivo Fabiano aduciendo incompatibilidad de opiniones, pues no aceptaba la posición "gradualista" y evolucionista de la socialdemocracia. Además formó parte del comité ejecutivo del partido (...) laboralista -aunque con serias disensiones con el premier MacDonald-, que debería estudiar los cambios originados en la acción socialista tras la primera Guerra Mundial. A su renombre puede haber ayudado el hecho de haber enseñado en las prestigiosas universidades de Mac-Gill de Montreal y en Harvard. De todas formas, a pesar de ser un pensador que extrajo sus teorías de la práctica y dar a sus aportaciones un contenido pragmático, como Hobbes o Locke, no se puede parangonar en ningún caso con ellos. Se trata -a pesar de sus bandazos- de un intelectual independiente de izquierda, postura que afirmó en su pertenencia al partido laborista. De esta suerte su teoría política pudo fundarse en la ética, que como se verá no se deja entremezclar con el materialismo histórico marxista. El Estado en la teoría y en la práctica corresponde al período en el que busca un acomodamiento de la teoría del Estado a las nuevas circunstancias, una fase que el autor inicia en la década de los treinta del siglo XX. Es un libro que desarrolla y amplía, como él deja claro, su libro anterior, La Democracia en crisis (1933), que también fuera traducido para Revista de Derecho Privado, y supone un perfeccionamiento de sus principios filosóficos. Laski se ocupa de diagnosticar las causas del fracaso y avanza un proyecto de teoría social que se propone desenvolver en el marco de ocho años. The practice of a priori conceptual analysis requires that the concept being analyzed be available in the analyst's mind. The difficulties of analysis and the existence of disagreements among analysts are explained by distinguishing the implicit knowledge we have of these concepts from the explicit knowledge we seek. This view of disagreement assumes that those who disagree are typically attempting to analyze a single shared concept. In this paper, reasons are developed for replacing this guiding assumption with the alternative assumption (...) that members of a conceptual community often have similar, but not identical, concepts. Adopting this alternative requires that we rethink the nature and aims of conceptual analysis. (shrink)
